Costco Wholesale Corporation in Class Action Suit For Mislabelling Milk Products

Costco has been sued because milk provided by Costco was improperly labeled as "organic."

Costco has not yet responded to the complaints; although it's milk supplier Aurora has maintained that it holds valid certifications and continues to hold these.

Costco has now received a grand jury subpoena from the United States Attorney's Office. The Central District of California is seeking to obtain records relating to Costco's receipt and handling of hazardous merchandise, as well as other records.

Costco was sued based on the failure of Costco to disclose on the label of its "Shrimp Tray with Cocktail Sauce" the weight of the shrimp in the item as distinct from the accompanying cocktail sauce, lettuce, and lemon wedges.

The plaintiff filed a motion for a preliminary injunction, seeking to prevent Costco from selling the shrimp tray unless Costco separately discloses the weight of the shrimp and provides shrimp consistent with the disclosed weight.

The court denied the preliminary injunction motion and dismissed the claim for breach of contract.

The court of appeals summarily affirmed these rulings.

The district court denied the motion of one plaintiff to file an amended complaint. However, the court of appeals affirmed the rulings of the district court.

Costco is being sued by present and former hourly employees because the company did not properly compensate and record hours worked by employees and failed to provide meal and rest breaks.

A $7.5m classwide settlement was tentatively approved by the Court. A hearing is scheduled for final approval of the settlement.

The case was filed in the United States District Court (Los Angeles).
